Terms of Service

These terms govern your use of Listently (the "Service"). By creating an account, you agree to them. If you don't agree, don't use the Service.
The Service
Listently lets you upload audio or video and get back a transcript with automatic speaker detection, translation, and an AI-generated summary. We offer a Free plan with usage limits (currently: 3 transcriptions per day, up to 30 minutes per file, 2GB max upload size) and a Pro plan with higher or no limits. These limits, and Pro plan pricing, may change — we'll do our best to give notice of material changes.
Your account
You're responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information when signing up, and you must be at least 16 years old to use Listently.
Your content, and your responsibility for it
You own whatever you upload, and the transcripts and summaries generated from it. By uploading audio or video, you confirm that:
- You have the right to upload and transcribe it — including, where the recording includes other people's voices, that you have whatever consent is legally required to record and transcribe them.
- It doesn't violate any law, or anyone else's rights (privacy, intellectual property, or otherwise).
- It isn't illegal content, and doesn't depict or facilitate harm to others.
We may remove content or suspend accounts that violate these terms, and we may investigate suspected abuse.
Acceptable use
Don't use Listently to:
- Upload content you don't have the right to upload.
- Attempt to disrupt, overload, or gain unauthorized access to the Service or other users' accounts.
- Use the Service to build a competing transcription product by systematically extracting its output.
- Violate any applicable law.
Accuracy of transcripts
Transcription, speaker detection, and AI summaries are generated automatically and can contain errors — misheard words, misattributed speakers, or an imperfect summary. The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, merchantability, fitness for a particular purpose, or non-infringement. Don't rely on a transcript alone for anything where a mistake would matter (legal, medical, or safety-critical use) without verifying it against the original recording.
Limitation of liability
To the maximum extent permitted by law, Listently and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service — even if advised of the possibility of such damages. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose, or €50 if you're on the Free plan.
Nothing in these terms limits liability where the law doesn't allow it to be limited — for example, liability for death or personal injury caused by negligence, fraud, or other liability that can't be excluded under the law that applies to you (including mandatory consumer-protection rules in your country of residence, if you're a consumer).
Indemnification
You agree to indemnify and hold Listently and its operator harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: content you upload, your breach of these terms, or your violation of any law or third-party right (including the rights of people recorded in your audio or video).
Copyright complaints
If you believe content processed through Listently infringes your copyright, email[email protected] with: (1) a description of the copyrighted work, (2) the material you believe infringes it and where to find it, (3) your contact information, and (4) a statement that you have a good-faith belief the use is unauthorized and that your notice is accurate, made under penalty of perjury. We will review and remove infringing content where appropriate, and may suspend accounts of repeat infringers.
Payment (Pro plan)
Pro subscriptions are billed in advance, on a recurring basis, through Stripe. You can cancel anytime from your account settings — you'll keep Pro access until the end of the period you already paid for, then move to the Free plan. We don't offer refunds for partial billing periods, except where required by law.
Deleting your account
You can delete your account at any time from your account settings. This permanently removes your transcripts, uploaded files, and profile — it can't be undone. If you have an active Pro subscription, deleting your account also cancels it and stops future charges immediately.
Termination
We may suspend or terminate your access to the Service if you violate these terms, or if we reasonably believe your use of the Service creates risk or legal exposure for us or other users.
Changes to these terms
If we make a material change, we'll update the date at the top of this page. Continuing to use Listently after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of Belgium, without regard to conflict-of-law rules, and the courts of Belgium have exclusive jurisdiction over any dispute — except that if you're a consumer resident in the EU/EEA or another jurisdiction whose law gives you mandatory protections or the right to bring a claim in your own courts, those protections still apply and this clause doesn't take them away.
